Payment

First-8 does not require payment until the item has been sent out or we have started providing the service (e.g. for a first aid course).

Once a customer has entered their payment information, the money is not withdrawn immediately, but reserved for the company. It is only when the item has been sent that we deduct the reserve amount.

 

Ownership of the item sold remains with the Seller (First-8 ApS) until the invoice is handed over to the buyer and the entire purchase price, including any interest and costs, is paid.

 

First time customer and invoice

For first-time purchases with an invoice, the following maximum amount applies:

Private purchase: DKK 9,000.00 incl. VAT

Company purchase: DKK 22,000 incl. VAT

We deliver with GLS or Postnord to both private addresses, company addresses and parcel shops - you can choose which type of delivery you want in the basket. Expected delivery time for the item appears on the order confirmation.

We have free delivery throughout Denmark (Faroe Islands and Greenland excepted) on orders over DKK 399. If you wish to collect the item, please contact our customer service. Unless otherwise agreed, delivery takes place to the agreed address on the order confirmation.

The risk for the goods during transport passes when the buyer receives the goods at the place of destination for delivery, unless otherwise stated in the order confirmation or invoice. When the buyer collects the goods from storage, the risk for the goods passes upon receipt of the goods at First-8 ApS's warehouse

Delayed delivery:
If the delivery of your item is delayed, you will be notified as soon as First-8 ApS becomes aware of the delay. You will also be notified when you can expect your item to be delivered.

Unsuccessful delivery:
If your package is sent back to our warehouse due to a lack of collection or possibility of delivery, you will be charged new freight for redelivery.

Force Majeure:
First-8 Aps' delivery obligation is postponed, limited or terminated to the extent that force majeure or other conditions over which the seller has no control may delay, complicate or prevent delivery. For example, force majeure and similar circumstances are considered war, rebellion, civil unrest, blockades, quarantine measures, strike, lockout, fire, import or export ban, ice difficulties, traffic and operational disruptions in general, as well as measures of any kind taken by public authorities or by authorities that can be equated hereby, either here or abroad, which may in any way hinder the seller's freedom of disposition. To the extent and as long as the seller does not deliver under the above circumstances, the buyer cannot claim compensation, possibly price differentials, etc. This also applies if the above conditions occur again during the term of the agreement.

You have a 14-day right of cancellation when you shop with us.

The cancellation period expires 14 days after the day you;

a) have received your item
b) takes physical possession of the last item in the case of an agreement for several different items ordered in one order and delivered individually
c) gets physical possession of the last lot, or the last part, in the case of an agreement for the delivery of a product consisting of several lots or parts
d) takes physical possession of the first goods in the case of agreements for regular delivery of goods over a specified period
You must notify us within 14 days of receipt that you wish to cancel your purchase. The notification must be given at [email protected]

In your message, you must make us clearly aware that you wish to exercise your right of withdrawal. You can also choose to use our standard cancellation form and send with return. You will find it at the bottom of this document

You cannot undo it by simply refusing to receive the item without clearly notifying us of this at the same time.

Cancellation of part of the purchase

If you have purchased several items from us, you have the option of returning one or more items, even if they were purchased in one order.

Please note that you will not get the shipping costs back if you regret part of your purchase.

No right of withdrawal
These agreements cannot be cancelled:

Delivery of non-financial services that have been completed, if you have previously agreed that the service will be started and that your right of withdrawal is thereby lost,
Delivery of goods that have been manufactured to your specifications or have been given a distinct personal touch,
Delivery of goods which can be assumed to deteriorate or become obsolete quickly,
Delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return and where the seal has been broken after delivery, Delivery of goods which, due to their nature, are mixed with other goods on delivery, and not can be disassembled again,
Agreements for specific urgent repair or maintenance work at your place that you have expressly requested,
Delivery of sealed sound or image recordings or computer software on which you have broken the seal,
Delivery of digital content, e.g. digital first aid, computer programs, apps, games, music, films, etc., which are not delivered physically on e.g. CD or DVD, if you have previously agreed that the performance will be started and that your right of cancellation is thereby lost,
There is also no right of cancellation on courses where a date has been set - read more in the course conditions.
Right of complaint in business purchases

There is a 1-year warranty for commercial purchases.

The customer has the right to complain to the Consumer Complaints Board about defects in gift cards if the customer has previously tried in vain to find a satisfactory solution with First-8. As a starting point, the customer can only complain to the Consumer Complaints Board if the product exceeds the amount limit for lodging a complaint. You must send your order back to us without undue delay and no later than 14 days after you have notified us that you wish to cancel your purchase. You must bear the direct costs in connection with returning the item. When returning, you are responsible for ensuring that the item is properly packed. You bear the risk for the goods from the time of delivery of the goods.

Due to their nature, certain goods cannot be returned by normal post. This applies to first aid courses. The costs for return are expected to amount to approx. DKK 50.

You lose your right of withdrawal if;

you break the seal on goods which, for reasons of health protection or hygiene, are not suitable for return.
you break the seal on sound or image recordings or computer software.
The condition of the item when you send it back

You are only liable for any deterioration in the value of the goods which is due to handling other than what is necessary to determine the nature, characteristics and way of functioning of the goods. In other words – you can try the product in the same way as if you tried it in a physical store. If the item has been tried on in addition to what is described above, we consider it as used, which means that if you cancel the purchase, you will only get a part or none of the purchase amount back, depending on the item's commercial value. In order to receive the full purchase amount back, you must therefore do the same as you can in a physical store. You may test the product, but not actually use it.

 

Refund of the purchase amount

If you regret your purchase, you will of course get the amount you paid us back. In the event of a decrease in value for which you are liable, this will be deducted from the purchase amount. If you exercise your right of withdrawal, we will refund all payments received from you, including delivery costs (but not additional costs resulting from your own choice of a delivery method other than the cheapest form of standard delivery that we offer), without undue delay and in any event no later than 14 days from the date on which we received notification of your decision to withdraw from this agreement. We will make such a refund using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise.

We can withhold the refund until we have received the item back, unless you have provided documentation that you have returned it before then.

If there is something wrong with the product (right of complaint)

The Purchase Act's defect rules may apply to goods purchases.

When you shop at www.First-8.dk, you of course have 24 months right of complaint. This means that you can either get the item repaired, exchanged, the money back or the price reduced, depending on the specific situation.

There is no right of withdrawal in B2B relationships.

It is of course a requirement that the complaint is justified and that the defect did not arise as a result of incorrect use of the product or other damage-causing behaviour.

How soon should I advertise?

You must advertise within a "reasonable time" after you have discovered the lack of the item. If you complain within two months of discovering the defect, the complaint will always be timely.

We will refund reasonable shipping costs

If the complaint is justified, we will of course refund your (reasonable) shipping costs.

Remember that the item must always be sent back in proper packaging, and remember to get a receipt for sending so that we can refund your shipping costs.

The personal information is registered with First-8 ApS and stored for up to five years, after which the information is deleted.

When personal data is collected via our website, we ensure that it always happens by giving your express consent, so that you are informed about exactly what information is collected and why.

The directors of First-8 ApS have access to the information registered about you.

The data controller at First-8.dk is First-8 ApS.

We store our customer information on an encrypted server.

We also collaborate with a number of other companies that store and process data. The companies only process information on our behalf and may not use it for their own purposes.

We only work with data processors in the EU or in countries that can provide your information with sufficient protection.

Information submitted to First-8 ApS is not passed on or sold in any way to third parties, and we do not register any personally sensitive information.

As registered with First-8 ApS, you always have the right to object to the registration. You also have the right to access what information is registered about you. You have these rights according to the Personal Data Act and inquiries in connection with this should be addressed to First-8 ApS via e-mail [email protected]

When you shop with First-8, you accept that First-8 may use the customer's name, company name and logo in our reference/partner section. This applies both to trade in products, services and courses.

In the effort to respect the User's privacy and to protect the personal data that is transferred, First-8 complies with the personal data protection rules in force at all times.

First-8 draws attention to the fact that it may be necessary to collect the Customer's personal data for use in dispatching the Customer's order, when the Customer asks for confirmation of the Gift Card's validity and when the person in question uses it.

In addition to the e-mail address that you provide when you confirm the validity of your Gift Card, First-8 processes the personal data collected for the purpose of registering and processing orders, managing your account, for market research, statistical purposes and for customer surveys.

In accordance with the Personal Data Act, you have the right to access, correct or delete your personal data as well as the right to object. To exercise these rights, you must send a letter to the following postal address:

First-8 is the owner or licensee of all rights to the components of which our online courses and the digital platform consist, including, but not limited to, text, photographs, images, symbols and logos. It is strictly prohibited to reproduce, manufacture, modify, transmit, publish or adapt the said components in any way in whole, in any medium or in any way use all or part of the above components without the prior written consent of First-8 .

Course conditions

An agreement has been concluded between First-8 ApS (hereafter referred to as the organizer) and the company/person who books a course with First-8 (hereafter engaged)

The fee for the agreement is paid after sending the invoice to the parties with a payment deadline of 8 days
Cancellation:

In case of committed cancellation less than 14 days before the completion of the event, 25% of the fee is paid.
In case of committed cancellation less than 7 days before the completion of the event, 50% of the fee is paid.
In case of committed cancellation less than 3 days before the completion of the event, 100% of the fee is paid.
Those involved allow the organizer to record both sound and images of those involved, the material may not be used for publication in its full length, but can be used in fragments such as marketing.

The organizer is entitled to refrain from teaching if the participant does not fulfill his obligations. In such cases, as well as in the event that the organizer, after showing up, is prevented from teaching as agreed, participants are obliged to pay the agreed price.

This agreement is entered into with the usual reservation for force majeure.

However, it is the responsibility of those involved to take measures to the greatest extent possible that can ensure teaching on the agreed terms.

1 General provisions:

1.1 The subscription conditions below apply to the company/buyer as a subscriber (hereinafter "the Customer") and First-8 ApS (hereinafter "First-8").

1.2 The subscription comes into force when the customer signs it.

1.3 The subscription then comes into force on the subscription date, unless otherwise agreed.

1.4 There is no registration fee.

1.5 If the subscription agreement is to deal with service visits (gold package) and this is to take place on non-bridged islands with Zealand, Funen or Jutland, an extra price will be charged for this. Contact us if this

1.6 If the subscription agreement is signed with a service visit, after which the defibrillator is moved to non-bridge-fixed islands such as Zealand, Funen or Jutland, a new price for a service visit must be agreed, otherwise the agreement on a service visit will lapse and be cancelled.

1.7 If the payment or provisions of the subscription agreement are in default during the period, First-8 can terminate the agreement.

1.8 The right of withdrawal for the agreement is 14 days from the conclusion of the agreement.

 

2 General:

2.1 The agreement can be terminated prior to the next collection by contacting [email protected]. When the agreement is terminated, all equipment must be returned to First-8 at the above address. The customer pays for postage in connection with the return.

2.2 First-8 lends a defibrillator for use by the Customer and laypersons. When the Customer enters into a subscription agreement with First-8, the defibrillator is the property of First-8. The ownership rights to other products linked to the agreement also belong to First-8 throughout the subscription period.

2.3 The customer must provide an e-mail to First-8 when creating the subscription agreement, this e-mail address will be used by First-8 to update about the subscription and invoices. The customer cannot therefore waive this important information relating to the subscription.

2.4 The customer is obliged to notify First-8 if the customer moves address, changes name, CVR number, e-mail address or ceases.

2.5 Setup and installation in connection with signing the subscription is not included, unless this service is purchased additionally, cf. 3.

2.6 Is this installation service not acquired cf. section 3., the customer himself is responsible for any outdoor defibrillator cabinet being installed and connected correctly by an authorized electrician to an external power source, cf. the instructions for use included with the defibrillator cabinet.

2.7 If the Heart Package contains a heating cabinet, the price of the power consumption for the cabinet is the Customer's, who therefore cannot invoice First-8 for this.

 

3 Additional services
3.1 All the heart packs include a service agreement on the replacement of the battery and electrodes upon expiry, these will be sent to the Customer with instructions on how this replacement must be carried out. If the defibrillator is put into use, the Customer must then contact First-8 in good time, who will send new electrodes and possibly a loan defibrillator if the leased person has been taken to hospital. When the leased defibrillator is back with the customer, the borrowed one must be sent back to First-8.

 

3.2 If an annual control visit (gold package) is part of the agreement, this will be carried out by First-8's technicians who will check the defibrillator and any cabinet. The defibrillator is kept up to date with the latest guidelines and software updates. The customer will receive notification of this well in advance of the service visit. This is to secure the address and agree on further details. Should the defibrillator not be available to First-8 at the agreed time, the Customer will be charged a fee of DKK 1,000 excl. VAT for an unsuccessful service visit.

 

3.3 If installation of the cabinet and defibrillator is paid for, this will be carried out by a professionally responsible partner at First-8, with the correct skills and liability insurance in relation to electrical installation and set-up. The benefit is paid as a lump sum.

3.4 For first aid and defibrillator courses, the general rules apply and the conditions for these are cf. First-8 course conditions.

3.5 If debriefing is part of the subscription, the Customer can contact First-8 after a situation where the defibrillator has been in use. The situation is then discussed with the customer by a professional trained in psychological first aid within 24 hours. The customer will be debriefed by telephone for 30 minutes. If it is assessed that there is a need for more than the 30-minute debriefing, this will be at the Customer's own expense.

3.6 All services must be requested via contact to First-8. First-8 is thus not obliged to cover services performed by another supplier, where the Customer himself has requested services outside of First-8.

 

4 Courses:

4.1 On all First-8 courses, it is our own instructors who teach. There may be up to 16 participants on our regular physical courses.

5 Changes:

5.1 The customer can change the subscription contract from month to month to a different type. The customer must send the requested changes to First-8 in writing with at least one month's notice before the end of the current payment period.

5.2 First-8 can change the subscription contract in writing with at least one month's notice before the end of a subscription period. If the customer does not wish to continue the subscription after the changes, the customer must notify First-8 in writing no later than 14 days after the customer has received information from First-8 about the changes. In that case, the subscription will continue unchanged until the current subscription period expires.

 

6 Termination:

6.1 When the subscription agreement ends or is terminated, the Customer must return the borrowed equipment safely and in a fault-free condition to First-8.

6.2 If the Customer defaults on the subscription agreement, First-8 can cancel the contract with the Customer at any time, including if the creation or monthly payment has not been paid no later than 14 days after the due date, or the Customer has not informed about changes of address or other deliberate and fraudulent concealments.

6.3 If First-8 cancels the contract as a result of the Customer's breach, the customer is obliged to return the defibrillator and other products in faultless condition and at their own expense to First-8's business address, just as First-8 is entitled to claim compensation as a result of the breach at least equivalent to the value of the remaining subscription period.

6.4 If the Customer or First-8 terminates the agreement, the Customer must have returned the equipment no later than 30 days after the termination, cf. point 2.1. If this is not done within 30 days, First-8 will be able to remove the equipment at the Customer's expense. This will cost a fee of NOK 2,500 incl. VAT.

 

7 Payment:

7.1 The subscription payment to the Customer is due monthly.

7.2 If the payment is not paid on time, First-8 can charge the Customer a reminder fee, cf. the rules of the Interest Act. If no payment is made, section 6.3 applies.

7.3 If the Customer does not pay on time and is in arrears, First-8 is not obliged to provide the services that are part of the subscription until the payment is settled.

 

8 Special responsibilities:

8.1 During the subscription period, First-8 delivers notifications regarding the replacement of batteries and electrodes before these expire.

8.2 The customer is responsible for continuously monitoring and contacting First-8 in the event of a fault or battery failure on the defibrillator that may occur in the period between replacements.

8.3 The limitations of liability in First-8's general subscription conditions apply to First-8 AED with the additional limitations set out in this section.

8.4 We recommend that the operation of the defibrillator is only carried out by people who have gone through the digital defibrillator training held by First-8 in connection with one of our courses.

8.5 The customer is responsible for the equipment as far as theft, fire and vandalism and other circumstances that cannot be characterized as normal wear and tear are concerned.
Should the equipment be lost, stolen or otherwise, First-8 will charge the Customer the price applicable at the time from First-8's webshop.

8.6 The customer is responsible for having the material properly insured. First-8 is entitled to receive a copy of the Customer's policy on request.

8.7 To the extent that nothing else follows from the inalienable rules of Danish law on product liability, First-8 is only liable for damage caused by a product delivered by First-8 to the extent that it can be proven that the damage is due to First-8's fault or negligence. In addition, the limitations of First-8's liability for damages stated in these subscription conditions, as well as First-8's general subscription conditions, also apply.

8.8 It is not First-8's responsibility if we cannot help the company in the event of unusual events that are beyond our control. These can be, for example, strikes, natural disasters, extreme weather and road conditions, war, terrorism, riots and unrest (force majeure).

8.9 First-8 is liable for damages according to the general rules of Danish law with the restrictions in the subscription terms. First-8 is only liable for damages or losses directly attributable to services provided to the customer. First-8 is therefore not responsible for operating losses, loss of profit or similar indirect or derived losses.

8.10 First-8's total liability for damages is limited to a maximum of DKK 5 million.

8.11 Damages for which the customer wishes to make First-8 responsible must be reported to First-8 within a reasonable time.

8.12 If the contract is breached by the subscriber, First-8 is entitled at any time to cancel the subscription in writing, for example if the subscription fee is not paid no later than 14 days after it is due or in the event of demonstrably incorrect information and fraudulent concealment.

If it is assessed that there is a need for more than the 30-minute debriefing, this will be at the Customer's own expense.

3.6 All services must be requested via contact to First-8. First-8 is thus not obliged to cover services performed by another supplier, where the Customer himself has requested services outside of First-8.

 

4 Courses:

4.1 On all First-8 courses, it is our own instructors who teach. There may be up to 16 participants on our regular physical courses.

5 Changes:

5.1 The customer can change the subscription contract from month to month to a different type. The customer must send the requested changes to First-8 in writing with at least one month's notice before the end of the current payment period.

5.2 First-8 can change the subscription contract in writing with at least one month's notice before the end of a subscription period. If the customer does not wish to continue the subscription after the changes, the customer must notify First-8 in writing no later than 14 days after the customer has received information from First-8 about the changes. In that case, the subscription will continue unchanged until the current subscription period expires.

 

6 Termination:

6.1 When the subscription agreement ends or is terminated, the Customer must return the borrowed equipment safely and in a fault-free condition to First-8.

6.2 If the Customer defaults on the subscription agreement, First-8 can cancel the contract with the Customer at any time, including if the creation or monthly payment has not been paid no later than 14 days after the due date, or the Customer has not informed about changes of address or other deliberate and fraudulent concealments.

6.3 If First-8 cancels the contract as a result of the Customer's breach, the customer is obliged to return the defibrillator and other products in faultless condition and at their own expense to First-8's business address, just as First-8 is entitled to claim compensation as a result of the breach at least equivalent to the value of the remaining subscription period.

6.4 If the Customer or First-8 terminates the agreement, the Customer must have returned the equipment no later than 30 days after the termination, cf. point 2.1. If this is not done within 30 days, First-8 will be able to remove the equipment at the Customer's expense. This will cost a fee of NOK 2,500 incl. VAT.

 

7 Payment:

7.1 The subscription payment to the Customer is due monthly.

7.2 If the payment is not paid on time, First-8 can charge the Customer a reminder fee, cf. the rules of the Interest Act. If no payment is made, section 6.3 applies.

7.3 If the Customer does not pay on time and is in arrears, First-8 is not obliged to provide the services that are part of the subscription until the payment is settled.

 

8 Special responsibilities:

8.1 During the subscription period, First-8 delivers notifications regarding the replacement of batteries and electrodes before these expire.

8.2 The customer is responsible for continuously monitoring and contacting First-8 in the event of a fault or battery failure on the defibrillator that may occur in the period between replacements.

8.3 The limitations of liability in First-8's general subscription conditions apply to First-8 AED with the additional limitations set out in this section.

8.4 We recommend that the operation of the defibrillator is only carried out by people who have gone through the digital defibrillator training held by First-8 in connection with one of our courses.

8.5 The customer is responsible for the equipment as far as theft, fire and vandalism and other circumstances that cannot be characterized as normal wear and tear are concerned.
Should the equipment be lost, stolen or otherwise, First-8 will charge the Customer the price applicable at the time from First-8's webshop.

8.6 The customer is responsible for having the material properly insured. First-8 is entitled to receive a copy of the Customer's policy on request.

8.7 To the extent that nothing else follows from the inalienable rules of Danish law on product liability, First-8 is only liable for damage caused by a product delivered by First-8 to the extent that it can be proven that the damage is due to First-8's fault or negligence. In addition, the limitations of First-8's liability for damages stated in these subscription conditions, as well as First-8's general subscription conditions, also apply.

8.8 It is not First-8's responsibility if we cannot help the company in the event of unusual events that are beyond our control. These can be, for example, strikes, natural disasters, extreme weather and road conditions, war, terrorism, riots and unrest (force majeure).

8.9 First-8 is liable for damages according to the general rules of Danish law with the restrictions in the subscription terms. First-8 is only liable for damages or losses directly attributable to services provided to the customer. First-8 is therefore not responsible for operating losses, loss of profit or similar indirect or derived losses.

8.10 First-8's total liability for damages is limited to a maximum of DKK 5 million.

8.11 Damages for which the customer wishes to make First-8 responsible must be reported to First-8 within a reasonable time.

8.12 If the contract is breached by the subscriber, First-8 is entitled at any time to cancel the subscription in writing, for example if the subscription fee is not paid no later than 14 days after it is due or in the event of demonstrably incorrect information and fraudulent concealment.

The agreement deals with the organizer holding a course with the engaged d. (see order confirmation) on introduction to the use of defibrillators.

The fee for the agreement is paid after sending an invoice from the engaged party with a payment deadline of 8 days

 

Cancellation:

In case of committed cancellation less than 14 days before the completion of the event, 25% of the fee is paid.

In case of committed cancellation less than 7 days before the completion of the event, 50% of the fee is paid.

In case of committed cancellation less than 3 days before the completion of the event, 100% of the fee is paid.

 

Participants allow the organizer to record both sound and images on the course, the material may not be used for publication in its full length, but can be used in fragments such as marketing. Situation pictures are taken of the course - Situation pictures are pictures where the purpose is to depict the actual situation in the picture. It can be a photo of a crowd at an event portrait photos.

The organizer is entitled to refrain from teaching if the Participant does not fulfill his obligations. In such cases, as well as in the event that the organizer, after appearing, is prevented from teaching as agreed, the organizer is entitled to the full fee/salary.

This agreement is entered into with the usual reservation for force majeure.

However, it is the duty of those engaged to the fullest extent possible to take measures that can ensure teaching on the agreed terms, regardless of delay or cancellation of means of transport.
